Terms and Conditions

1. General Policy

The following terms and conditions shall govern all our offers, sales and shipments and may not be changed except with our written consent. These terms and conditions are effective when an order is placed. Differing agreements are valid only with written confirmation.

2. Freight

Unless otherwise requested at time of order, W&W will try to ship as quickly and efficiently as possible, however, does not guarantee the most economical route. The buyer will be charged for all shipping costs. With each shipment we will charge a proportional cost price for package. Parts shortages and damaged merchandise must be reported within three working days of receipt of order.

3. Prices

Our price lists show prices in Euro (€), F.O.B. shipping point. The retail prices include VAT. We reserve the right to increase prices anytime if we face cost increases through wages, exchange rates or other factors. All orders will be shipped C.O.D. unless other payment terms have been established. The goods delivered remain our property until payment is complete.

4. Product description and design

We reserve the right to change specifications, product description, product quality and application at any time without prior notification. We shall not be liable for errors in regards to listings, specifications, part numbers or model application. Most pictures and illustrations in the catalog are not true to scale.

5. Back Orders

Items temporarily out of stock are not automatically backordered. If you wish backorders, please indicate at time of order. Available back orders are shipped free freight. After 90 days backorders are cancelled. In this case customer has to reorder. If you wish to delete items from your backorder list please do so by providing your customer number, invoice number and part number.

6. Returns

New, unused merchandise in original packaging can be returned for credit or exchange within 6 weeks after date of shipment. Excluded from this is merchandise which

  1. does not belong to the regular selection of the W&W catalog.
  2. is specially ordered upon customer´s request.
  3. is sold cut to length (e.g. oil lines).

Always call our sales department before returning any merchandise. All returns must be accompanied by an invoice copy. Dealer customers must send returns prepaid.

We reserve the right to charge shipping costs afterwards if

  1. sender of returned merchandise is a dealer customer.
  2. returned merchandise is worth less than €40,–.
  3. warranty does not apply (see term no. 7).

7. Warranty

We will warrant any merchandise sold to retail customers for 2 years provided that the product has been installed and used properly.

Not accepted for warranty are parts

  1. that have been modified and/or misused.
  2. that have been installed on motor­cycles they are not intended for.
  3. that are consumable items (e.g. sparkplugs, filters).

Some replacement parts offered in our catalog do NOT include instructions. These are included only if installation differs from the procedure described in the respective factory service manual. The consideration of official service manuals and common rules of the mechanic profession is the duty of the person who installs the the part on the motorcycle. Noncomplience with this rule voids any warranty.

8. Federal & Local Laws

The installation of some W&W parts may void your factory warranty or violate federal and local laws when operating your vehicle on public highways. It is the sole responsibility of the user to determine the suitability of the product. In case of doubt call one of our representatives.

9. Dealer Prices

Dealer prices will be granted only to motorcycle businesses whose main object is selling Harley-Davidson® motorcycles, parts and accessories. The minimum purchase per year is €7.500,-. The initial order must exceed €1.500,-. We do not sell at dealer price level to other firms like gas stations, car dealerships or mail order companies without a retail store. In order to receive dealer prices new customers must provide a copy of the Business License, a business card, letter head or retail ad and a photograph of the storefront. We also require that these businesses have regular store hours. The dealer status will be withdrawn if above requirements are no longer met.

10. Place of Performance, legal validity of contractual conditions

Competent is the law of Germany. Place of performance is Wuerzburg, Germany. Competent court for disputes with buyers who are merchants or legal persons, is the one having jurisdiction over the place of our company. We reserve the right to bring an action against the buyer at the place of buyer’s head office.
